Brighton, Lochbuie, Weld County, Colorado and Congress are separate authorities. DCAP does not collapse them into one legal story.

Weld County adopted data-center-specific zoning.

Weld County says Ordinance 2026-01 applies to unincorporated Weld County: data centers are permitted only in industrial zones, require Use by Special Review in I-1 or Site Plan Review in I-2/I-3, and are prohibited in the agricultural zone. The ordinance also includes electricity/water documentation and noise standards.

Colorado considered two major bills in 2026.

SB26-102 · Large-Load Data Centers

Created proposed requirements for qualifying large-load data centers. The Senate Transportation & Energy Committee postponed the bill indefinitely on May 11, 2026, 9-0.

Proposed a state data-center development/incentive framework tied to utility modernization and consumer/environmental protections. The House Energy & Environment Committee postponed it indefinitely on May 7, 2026, 11-2.

Federal grid-cost question.

H.R. 9340, the Ratepayer Protection Act, addresses recovery of full incremental grid-upgrade costs for large-load customers. On September 30, Senate cloture on the motion to proceed was not invoked, 57-43.
